Application for Court Appointed Counsel: The State of West Virginia will appoint a lawyer to represent an
individual who is charged with a crime that has a potential sentence of incarceration and who also qualifies as
indigent. To receive court appointed counsel a defendant must fill out the Affidavit for Court Appointed Counsel completely, date it, sign it and have it notarized. If a question on the form does not apply, please answer “0”.
Failure to fill out this application completely will cause it to be denied. Provide this form to the Magistrate Court within two weeks of your arrest to ensure that you will have legal representation at the time of your court date.
